2.11 ‘Delivery Place’ refers to the delivery address as specified by you, the Buyer, on any Order.

2.12 ‘Order’ refers to your offer, as the Buyer, to purchase Products from UK Bed World, whether electronically or via other means.

2.13 The term `’Contract’ refers to any contract between the Buyer and UK Bed World (the seller) for the sale and purchase of Products incorporating these conditions, whether completed electronically through this website or via other means.

2.14 ‘Delivery Place’ refers to the delivery address as specified by you, the Buyer, on any Order.

2.15 ‘Order’ refers to your offer, as the Buyer, to purchase Products from UK Bed World whether electronically or via other means.

3.0 The Contract and your Orders

3.1 By placing an order through our site, you warrant that you are legally capable of entering into binding contracts.

3.2 Each order placed by the buyer will be deemed to be an offer by the buyer to purchase products from UK Bed World, the seller, subject to these conditions.

3.3 If the seller decides to refuse the buyer’s offer for whatever reason, then the seller will notify the buyer as soon as possible. As a result, the two parties will not have a legally enforceable contract.

3.4 All orders are subject to acceptance. All details supplied to UK Bed World must be true and accurate. If we accept the order, we enter a contract with you.

3.5 If there are any problems with your order, we aim to contact you as soon as possible.

3.6 If you have difficulty placing an order, please contact our sales team who will assist you.

3.7 The Buyer shall make sure that the information he gives to the Seller is correct, and that he delivers all required information related to the Delivery of supplies on time so that the Seller can execute the Contract in line with these terms.

4.0 Description and Specification of Goods

4.1 All images displayed are indications of the product; some items may have small variations in ticking and colour, usually as a result of different screen resolutions.

4.2 The quantity and description of the Products shall be set out in the Seller’s confirmation.

4.3 The Seller may make changes in the specification of the Products which do not materially affect their performance required to conform with any applicable statutory requirements where the Products are supplied to the Seller’s specification.

5.0 Price

5.1 The customer agrees to pay the price to the seller company which is UK Bed World.

5.2 These prices include VAT but exclude delivery costs and VAT, which will be added to the total amount due. Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an Order Confirmation.

5.3UK Bed World may, at their discretion, offer free or discounted delivery on occasion.

6. Payment of goods

6.1 In consideration of the supply of goods by the company to the customer shall pay the company the price.

6.2 Once the order has been placed, payment for the goods will be due from the customer in full. Only then will a contract exist.

7.0 Delivery

7.1 The seller shall deliver the goods to the customer in exchange for the payment of the price of the customer on a date to be notified, and wherever possible agreed with the customer.

7.2. The company shall strive to make the delivery within 14 days of the date of the contract. However, the company shall not be liable for any penalty loss, injury, damage or expense arising from any delay or failure in delivery or performance of the contract from any cause at all, nor shall any such delay or failure entitle the customer to refuse to accept any delivery, under the contract, performance of the contract, or to reject the contract.

9.0 Limitation of Liability

9.1 UK Bed World accepts no liability for any potential losses or damage, foreseeable or otherwise, including indirect, consequential, special, or exemplary damages arising from the use of this website, or any information included within, to the fullest extent permissible by law.

9.2 The Seller’s total liability for any claims of whatever nature and however arising (whether from breach of contract or negligence or otherwise) against the Seller, its employees and subcontractors shall be limited to the price of the product they have purchased.

10. Disclaimer of Warranties

10.1 The goods on UK Bed World are provided “as is “and “as available basis” (except as expressly stated by us) for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose.

10.2 UK Bed World makes no representations or warranties, expressed or implied, about the accuracy, likely results, or reliability of the use of the materials on its Internet website or elsewhere related to such materials or on any sites connected to this site.

11. Risk/ Retention of Title

11.1 The risk in the goods shall pass to the customer from the time of the delivery.

11.2 The company shall reserve the title and ownership of the goods until the price and all sums outstanding by the customer to the company are paid in full.

12. Force Majeure (Events Outside of Our Control).

12.1 UK Bed World will not be liable or responsible for any failure to perform or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).

12.2 A Force Majeure Event includes (without limitation) the following:

(a) strikes, lockouts or other industrial action
(b) civil commotion, riot, invasion, piracy, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
(c) inclement weather, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters.

12.3 In Force Majeure (extreme circumstances outside of our control) the UK Bed World may, at its absolute discretion, terminate any contract for the supply of goods according to the order form, or cancel the manufacture and/or delivery of the goods. In such circumstances, the Company will consult with the Customer to try to find suitable alternatives that may be possible.

13. Severance

(a) If any provisions, (or a part of a provision) of this agreement are severable, such provisions shall be construed and shall have effect as severable, separate and independent conditions.

(b) If at any time one or more of such provisions or any part or parts of the provisions hereof be held invalid, illegal, or unenforceable in any respect, the legality, validity and enforceability of the remainder shall not be affected or impaired thereby.

14. Complaints

14.1 In the unlikely event of a complaint of damaged goods the Seller must be notified in writing within 2 days of delivery. We reserve the right to credit or replace any goods deemed by us to be faulty.

14.2 The liability of the Seller in the event of a complaint, is limited to the value of the goods supplied. Under no circumstances will consequential claims be entertained.

14.3 Please note: We are continually striving to improve the products available and as such reserve the right to change the specifications of any products at any time.
